On Further Development of the UA Domain Zone

The Ukrainian Internet Association (IUKA), the Ukrainian Union of Industrialists and Entrepreneurs (UUIE) and the Public Council at the State Informatization Committee of Ukraine held on September 10, 2009, Round Table Dedicated to Further Development of the UA Domain Zone.
Mr. Oleksandr Mamunya, senior associate practicing intellectual property attended the event on behalf of Vasil Kisil & Partners, a member of the Ukrainian Internet Association.
The attendees included representatives acting for domain registration domestic market players, public organizations and professional associations, as well as managers and representatives of the State Informatization Committee of Ukraine, the Antimonopoly Committee of Ukraine, the National Security Service, the State Service of Ukraine for Specialized Communication and Information Protection, the State Communication Administration, the Secretariat of the Cabinet of Ministers, Members of the Coordination Board at the Ukrainian Network Information Center, and representatives of well-known companies in the industry, about 60 persons in total.
The Round Table participants went over some important issues such as: the development of the registration system, administration, technical maintenance, and use of UA domain names.
There were a number of proposals concerning the further development of the UA domain names. In particular, these proposals dealt with how to divide legislative, technical and judicial elements of the UA domain administration, extrajudicial settlements of domain-related disputes, registrar accreditation principles, requirements to the UA Domain Rules, necessary legal embodiment of respective regulations in the domain industry, necessary rotation of Coordination Board members, taking into account actual operating results of public organizations and associations represented in the Coordination Board, and involvement of all three branches of government, legislative, executive and judicial, to participate in such body.
Relying, in particular, upon the experience of Vasil Kisil & Partners acting in such matters, in his speech dedicated to UA domain names disputes Mr. Oleksandr Mamunya touched upon the following:
- Restricted access to the information related to actual registrants of domain names and administrators of regional domains.
- Uncertain procedural status of Hostmaster LLC in domain disputes;
- Difficulties in finding out a proper way to protect violated rights in domain disputes;
- Enforcement of judgments rendered in disputes of such category.
Finally, Mr. Oleksandr Mamunya said that the domain disputes resolution procedure should be transparent and efficient in Ukraine since these very criteria were the key determinants for a domain zone to be attractive for users.
Most proposals of the Round Table participants were laid down in the Resolution of the Round Table which was intended by the participants to be sent to a number of dedicated legislative and executive bodies.
